The real problem is OPT. OPT, on a SHALL ISSUE basis provides non-citizens who graduate from a US college a 180 day window to find a Job, and then they can stay on OPT up to 5 years, which guarantees a green card if you play your cards right.
OPT is only for a year. Where are you getting the 5 years from?
Also the durations is 90 days not 180. That 90 days is not reset on being laid off.
Because of the SHALL ISSUE extensions. For example the route to 5 if you are a STEM graduate is:
standard opt (12 months) -> STEM OPT extension (+24 months) -> Master's Extension (+12 months) -> Cap Gap pending H1B or o-1 conversion (+6 months) -> STEM final grace period (+5 months)
Its plus or minus 90 days from graduation date, making the total window a 180 day window. For non-stem if they lose their job during opt they have 90 days to find another, for stem they have 150 days.
