They smell it. And if they think they can smell booze they give you the ticket. Up to you to prove a negative, which is impossible.
Infraction, fine up to $250.
A person does not have to let them smell it.
Maybe once all cops have bodycams. But personally I’ve had cops give me completely fictitious tickets on multiple occasions.
When you tell a cop he can’t illegally search your car, he just dumped a soda in your backseat.

Yep, 20 years ago and I’m still pissed.
I was a punk rock kid and cops would just fuck with us.
Another time a police officer in Claremont pealed the registration sticker off my license plate and then gave me a ticket for it.
There is no excuse for no body cameras now. But 1/2 of law enforcement I see still doesn’t have them.
I guess we all have similar stories from our younger days about why we don't like cops today.
What’s the most screwed is now I have all the opposite stories.
My iPhone is stolen, ‘fine my iPhone’ has its location, police tell me to just file a report and claim the insurance.
Kids breaks into my house and leave spray paint cans with little blue fingerprint everywhere. Too busy to follow up on petty theft and misdemeanor vandalism, “this isn’t CSI, get a dog.”
So I agree all cops should wear body cams…but really…how much of that footage is really going to be usable in the long run if it’s against the cops? It’s going to be “lost” or have had “bad connection or battery” if stuff really goes down. The best you can do in a traffic stop is record on your own phone. And lawyer up/ know your rights.
But ya, I’ll definitely agree things were probably different 20 years ago than today, especially if you (in your own words) were a punk kid that got pulled over (in clairemont back then, nonetheless) and (I’m assuming here) probably weren’t the most polite to the officer. Not saying the soda and registration thing were ok at all, but a body cam wouldn’t have helped that.
The stolen iPhone, ya that sucks. But not really a huge emergency on their part nowadays when their workforce is so low. Going with you to some random location to ask for a phone back without a search warrant is a really low priority. I’m sorry you got your phone taken from someone dumb enough to leave the location on as well.
Also the vandalism. Your property was trespassed! Also not great. But did they actually spray your house? How’d you know it was a kid? There’s stories all the time if unhinged guys wandering naked through neighborhoods and breaking into people’s backyards or houses repeatedly and the best the police can do is maybe round them up and then release them a few days later cuz they didn’t “hurt anyone.”
Also I doubt the cops can smell alcohol from open containers on the beach, unless they were right up to the can breathing it in. They probably see the containers and target you from there. You could definitely prove you don’t have alcohol by showing them what you have and having them actually smell what you’re drinking out of in that case?
Yep. For the mostpart, cops are more of a problem for citizens than a service.
